Call 1-800 INJURED After a Miami Car Accident

According to the Association for Safe International Travel, approximately 1.3 million people die every year by car accidents. On average, that's 3,287 deaths every day. Moreover, an additional 20-50 million people are injured or disabled annually because of car crashes.

These figures are sobering. However, these statistics do not convey the physical, emotional, and financial burdens forced on victims with a personal injury. Car accidents can result in expensive property damage, devastating personal injuries, and even death.

It's unfortunate that many individuals have to fight haggling car insurance companies to get the coverage they need to recover. Luckily you don't have to do it alone. Florida’s No-Fault Insurance Laws

Florida is a No-Fault insurance state. This law requires drivers to file damage claims with their insurance after an accident. It also requires all vehicles with four or more wheels to purchase Florida car insurance, with a minimum of $10,000 in Personal Injury Protection (PIP) and Property Damage Liability (PDL) coverage each.

The PIP benefits of your insurance are meant to cover medical bills and lost wages. However, the law only requires insurance companies to pay 80% of medical bills and 60% of lost wages. Moreover, depending on the deductible of your insurance, you may be responsible for the first grand in out-of-pocket expenses before your coverage kicks in. PIP benefits extend to pedestrians or cyclist hit by your vehicle and can for relatives living in the same household driving the insured car.

Expenses that are not covered by your auto insurance could be paid for by your health insurance. For example, MedPay handles first-party claims and pays for medical bills regardless of fault. MedPay won't compensate for any lost wages, but it can pay for the deductibles, coinsurance, and copays of other insurance types, including your PIP coverage. So after your car insurance pays for 80% of your medical bills, MedPay would cover the additional 20%. MedPay coverage is optional, and the benefits you have with your health insurance company depend on your policy. Contact your health insurance provider for a better understanding of the plan you currently have.

Exceptions to Florida’s No-Fault Statute

Florida law also allows individuals to file a suit against the liable driver for damages if they meet specific requirements.

For starters, if you are not responsible for an accident and have suffered a permanent injury, you can sue the at-fault driver for economic and non-economic damages. By law, a permanent injury is a permanent loss of a vital bodily function, significant scarring, disfigurement, disability, or death. Victims with a personal injury can recover economic damages, which would cover the cost of past and future medical bills, lost wages, and loss of earning potential. Non-economic damages compensate for intangible injuries like pain and suffering, loss of comfort, anxiety, and mental anguish.

You can also sue the responsible driver if your medical bills and lost wages exceed the PIP $10,000 limit. In these cases, compensation can be recovered for any out-of-pocket expenses stemming from the accidents, including present and future lost wages, loss of earning capacity, medical bills, and medical payments.

Auto Insurance Claims After an Accident

You will need to notify to car insurance company of any car accidents. When explaining what happened, it would be wise only to give your insurance provider the evident facts. What you say can be used as evidence in your case, so it's better to be safe and only provide them with the information they need.

After the proper steps have been taken, your insurance provider will offer your claim an amount for settlement. It is likely that this first offer will not be the best. Insurance adjusters are trained to lowball clients to protect the company's bottom line. They will try to save money by forcing you to sign a settlement as soon as possible. You might be tempted to settle for some temporary relief, but you should resist this urge. If you were injured in the accident, it might take weeks before the symptoms begin to appear. Medical conditions worsen over time, and the quicker you settle, the less likely all of your injuries will be covered.

Benefits of Hiring an Attorney

Insurance companies are reluctant to make proper claims, and frequently restrict payouts. They don't want you to hire a lawyer. Adjusters know that an experienced attorney will fight for your best interest and likely get you more money. This trend is precisely why you should hire an attorney.

Our network of trusted attorneys have the knowledge and tenacity to get the best possible result for your case.
