Accident Liability

Accident liability involves determining who is at fault and hence, is legally responsible (liable) for the accident.

Locating the party at fault may not be simple and obvious as the decision usually rests on motor vehicle statutes rather than the common legal definition of “fault”. For example, if the driver of the vehicle is found to have done illegal lane changing or over-speeding just before the accident happened, the other party may not be held responsible for the collision.
